Paul: Tomorrow is a big day for California homos…

…CA Supreme Court to issue important ruling on gay marriage.

Back in 2000 California voters approved a measure defining marriage as between a man and a woman, odds are that wherever you live your state has done some similarly shitty thing. In California several parties have sued to challenge the constitutionality of that measure, their lawsuits were combined and made it up to the state’s high court, which heard oral arguments in March. I listened to some of the arguments when the hearing was broadcast on CSPAN.

The basic argument is that by not allowing gay people to have full marriage rights (even though there are domestic partnerships) they are not afforded equal protection under the law, a constitutional right. The court may say that domestic partnerships are enough, but rumors are circulating that the court is set to say that they aren’t – that gays have a constitutional right to marry just like everyone else. There is a strong and obvious argument that setting up a separate system for gays is akin to separate and unequal schools during segregation.

The opinion should be issued at 10:00 AM tomorrow morning. If the court does the right thing we should all be ready for a political shitstorm. Gay marriage has thankfully not been a big issue in this year’s presidential election, but if the biggest state’s high court finds that there is a constitutional right it will quickly become one. On the up side, even if these efforts fail they are providing a model for overturning the anti-marriage measures that have passed all over the country. If California overturns their’s, expect other states to follow.

    we won! well, technically i didn’t do that much to help, but i did volunteer once during the campaign to overturn this shit. i shall do my part tonight by drinking champagne, possibly in west hollywood, and i plan to get involved however i can to fight those who want to stop this big gay ship from rolling right in.
